A products liability claim or lawsuit is a subtopic of personal injury law. Companies, corporations and/or manufacturers of products, which are defective and cause injury or death, can be liable to the individual for the defect of the product. A products liability claim can be founded in negligence, a breach of warranty and a strict liability claim. A product can be unsafe and can cause injury or death when there is a defect in the manufacturing or design phase of the product. The failure to warn or to properly warn the consumer of the proper use or safety concerns of a product can also lead to a claim under product liability. Companies, corporations and manufactures which produce or sell such products owe a responsibility to the consumer to insure that the products are safe, safe for their intended use, and will not result in injuries or death during the use of the product.
